By accessing and using TubExperto (“the Service”), you agree to be legally bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our service.

These terms apply to all visitors, users, and others who access or use the Service.

TubExperto is an artificial intelligence platform that allows users to create “virtual experts” based on YouTube channel content. The service:

• Processes and analyzes YouTube videos using AI
• Generates responses based on specific video content
• Provides timestamps and references to original videos
• Allows interaction through chat with YouTube channel content

Nature of the service: TubExperto is a search, analysis and research assistancetool. It does not reproduce the videos nor does it offer the transcription as a standalone product: it uses the publicly accessible transcription as input to generate transformative outputs (summaries, chapters, semantic answers with citations, infographics, audio summaries) that reference the original work.

This processing is carried out under fair-use criteria (US jurisdictions) and the text and data mining exceptions of Articles 3 and 4 of Directive (EU) 2019/790 (EU jurisdictions), always preserving the link back to the original video so that the viewing and monetisation flow to the creator.

3.1 Registration

To use certain features, you must create an account. By doing so:

• You must provide accurate, complete, and current information
• You must be at least 18 years old
• You are responsible for maintaining the security of your password
• You are responsible for all activities that occur under your account

3.2 Suspension and Termination

We reserve the right to suspend or terminate your account if you violate these terms, without prior notice and without refund.

Authorised purposes: personal use, research, education, journalism, accessibility, AI-assisted content analysis and creator productivity.

Not permitted:

• Using the service for illegal or unauthorised activities
• Violating third-party intellectual-property rights
• Attempting to access systems or data in an unauthorised manner
• Distributing malware, viruses or malicious code
• Reverse engineering the service
• Using the service to create defamatory, obscene or illegal content
• Automating access in a way that overloads our systems or circumvents our rate limits
• Reselling or redistributing the service without authorisation
• Impersonating another person or entity
• Republishing full transcripts as a standalone product (scraper-style sites, transcript marketplaces, caption-mirror SEO) without express permission from the creator
• Using the service or its outputs to train, fine-tune or evaluate third-party generative AI modelswithout a specific written agreement
• Circumventing the technical limits of the service (credits, rate-limits, number of sessions of the MCP Link) through multiple accounts or token sharing
• Using derivative content without preserving attribution to the original creator (channel name + link to the video) when the content is shared publicly

5.1 TubExperto Content

The service, including software, design, text, graphics, and other materials, is owned by TubExperto and is protected by intellectual property laws.

5.2 YouTube Content and Legal Disclaimer

How our service works:

• We access only PUBLIC YouTube content through the official YouTube Data API and standard client endpoints
• We DO NOT redistribute YouTube videos: we never host, share or make the source video streamable from our servers
• We process publicly available transcripts for semantic analysis. When captions are not published, we may transiently extract audio only to generate an automatic transcript, and we delete the audio file immediately after processing
• We generate AI-derived artifacts (summaries, responses, chapters, infographics, trailers, translated or dubbed audio) based on the transcript or short extracts of the content, always for reference, accessibility and private study purposes
• Any derivative artifact generated by TubExperto always includes an explicit reference link to the original YouTube video and is subject to the same exclusion request flow described below

For content creators (opt-out): if you are the owner of a YouTube channel and do not wish for your content to be processed by TubExperto, send a request from the email associated with the channel to [email protected] including the channel URL and evidence of ownership (e.g. a temporary pinned post). We commit to process opt-out requests within 7 business days and to stop indexing new videos. Already processed content will be removed from the public index and from new user searches.

Content ownership: All YouTube video content belongs to their respective creators and is subject to their licenses. TubExperto only provides analysis and references to original content without claiming any ownership rights over the source material.

5.3 Your Content

You retain all rights to the queries and data you input. You grant us a limited license to process your content for the purpose of providing the service.

6.1 Paid Plans

We offer both a free plan and paid plans with additional features. Prices are clearly displayed on our pricing page.

6.2 Billing

• Subscriptions are billed on a recurring basis (monthly or annual)
• Payments are securely processed through external providers
• You must maintain valid and current payment information
• Prices may change with 30 days prior notice

6.3 Cancellation and Refunds

• You can cancel your subscription at any time
• No partial refunds for unused periods
• Upon cancellation, you maintain access until the end of the paid period
• We offer a 7-day satisfaction guarantee for new subscriptions

7.1 Content Accuracy

AI-generated content is created automatically and may contain errors or inaccuracies. TubExperto is not responsible for the accuracy, completeness, or reliability of generated responses.

7.2 Service Availability

The service is provided “as is” and “as available”. We do not guarantee that the service will be uninterrupted, secure, or error-free.

7.3 AI-Generated Output Disclaimer

Answers, summaries, chapters, infographics and any other AI-generated output may contain errors, fabrications (“hallucinations”), omissions or biases. They must not be used as a substitute for professional advice (legal, medical, financial, engineering, etc.) nor as a sole source in journalistic publications without independent verification. The user is solely responsible for reviewing and validating any output before relying on it or republishing it.

7.4 Liability Limits

To the maximum extent permitted by applicable law, TubExperto shall in no event be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or use, even if advised of the possibility of such damages.

The aggregate liability of TubExperto for any claim arising from or relating to these Terms or the use of the service shall be limited to the greater of the amount paid by the user in the twelve (12) months prior to the event giving rise to the claim or one hundred euros (€100).

Nothing in this section limits the rights that European Union consumers have under mandatory consumer-protection legislation that cannot be waived by contract.

You agree to indemnify, defend and hold harmless TubExperto, its directors, employees, collaborators and affiliates from any claim, damage, obligation, loss, liability, cost or expense (including reasonable legal fees) arising from or related to:

• Your use of the Service or its outputs
• Breach of these Terms by you
• Violation of third-party rights, including intellectual-property, image, honour or privacy rights
• Claims by YouTube creators regarding the use you make of summaries, transcripts, chapters or other derivative content, when such use exceeds the purposes authorised by the service
• Use of the service for training, fine-tuning or evaluating third-party generative AI models when it is not expressly authorised
• Acts carried out through your account or your MCP Link token, even if performed by AI agents or third parties acting on your behalf

TubExperto respects third-party intellectual-property rights and responds to allegedly infringing-content claims in accordance with the Digital Millennium Copyright Act (DMCA, USA) and Article 17 of the Spanish Ley de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE).

If you believe that content accessible through our service infringes your copyright, please send a notification to [email protected] including:

• Identification of the allegedly infringed work
• URL or specific location of the allegedly infringing content on TubExperto
• Your contact details (full name, address, email, telephone)
• A good-faith statement that the use is not authorised by the rightsholder
• A statement, under penalty of perjury, that the information is accurate and you are authorised to act
• Physical or electronic signature

Upon receipt, we will review the notification within 5 business days and, if appropriate, will remove the content and notify the user who supplied it. Repeat infringers will have their accounts terminated. The affected user may file a counter-notification under the standard DMCA procedure.

We reserve the right to modify or discontinue the Service (or any part thereof) at any time. We may also update these Terms. We will notify you of significant changes through:

• Email to your registered address
• Prominent notice on the website
• Notification within the application

Continued use of the Service after changes constitutes your acceptance of the new terms.

Entire Agreement: These terms constitute the entire agreement between you and TubExperto.

Severability: If any provision is invalid, the remainder shall remain in effect.

No Waiver: Failure to exercise a right does not constitute a waiver of that right.

Assignment: You may not assign these terms without our written consent.
